DRIVERS BE AWARE IF YOU POLICY IS UNDERWRITTEN BY UNITED EQUITABLE INSURANCE COOMPANY
The claims manager at United Equitable Insurance Company of Skokie, Ron Clark, denied a auto theft claim after he said the Chrysler company informed him that it would be impossible to steal a 2006 M300 without the use of Chrysler keys and there is no record of a M300 theft ever covered by insurance in the United States. The exclusion in their policy does not cover a theft if keys were used.
The vehicle was purchased used from New Rogers Auto Group in Chicago in August of 2006. The owner received one key on the day of the vehicle sale and waited three days for the salesperson to obtain the second key from an unknown person. The vehicle was stolen off the street in the south side Pullman area where the owner parked to board the Metra train in October of 2008.
Robin Tillery, an insurance analyst at The Illinois Department of Insurance supported the theory given by United Equitable as a basis for the claim denial. Although they could not provide any proof to support their claim, the only keys issued to her by the dealership were on her person at the time of the theft and since the vehicle was never recovered they could not provide a physical inspection report.
This standard set by the Illinois Department of Insurance allows the writing in the exclusion of the policy not to cover a theft unless the vehicle is recovered and it is proven physical force was used. The outstanding balance owed to the finance company could send the owner into bankruptcy over this single debt. The vehicle was financed by Regional Acceptance Company (BB&T) and they are now seeking to recover $20,000.00 from the owner after a one year battle with the insurance company.
Many Illinois residents fall within the middle income range where their income is not low enough to qualify for free legal assistance, but they cannot afford the great legal expense required to fight against corporate staff attorneys.
This is another example of how honest working American citizens are being fleeced by big businesses that receive bail out money to maintain their financial status while destroying household finances of working families.
Inquiries from Illinois government offices, the Better Business Bureau, accident victims, private attorneys and the insured were routinely ignored by the insurance company. The owner was placed with United Equitable through agents at Great Northern Insurance that did not assist in any way with the claim process.
I had a lawyer call to inquire and the employee at United Equitable HUNG UP while he was speaking.
A tow-truck theft ring investigation by Pam Zekman of CBS 2 news proves any car can be stolen without keys.
Vehicle insurance is mandatory in Illinois, but they do not have the resources to monitor all the insurance companies.
