We had a young lady run into our truck. Her insurance company is not covering the damage* at her request * to our truck .So we have a 1000.00 repair bill . What should we do?
The claim is commonly know as a Mini-tort. and yes the letter does say "AT THE REQUEST OF OUR INSURED, WE ARE NOT MAKING AT PAYMENT"

Seek out an attorney, call your ins. company or take them to small claims court.

Recently got into a minor accident and forgot to take down the name of the other party’s auto insurance. The policy number has a format of ###-######-10/18. Calls to their phone number are also not being answered so any help would be greatly appreciated.
Also, this occured in Los Angeles and the car had a CA plate as well if that’s any help.

one thing a cop told me is you have to call a cop because its a felony if you drive off and they can come after you so its best to stay

How can you find out what auto insurance company a person has?

July 16, 2010 - 10:14 pm 4 Comments

A friend of mine had their parked car damaged by a driver and the person that did it is not willing to give out their insurance information. There was a police report and unfortunately the insurance information was not captured. Is there any ways to find out what insurance company a person has? Maybe through the DMV or alternative? I realize they may not have insurance but it still would be worth to find out. The damaged car only has liability insurance.

The only way to find out what insurance the person carries is one…. if you have a license plate #…which you dooo… u would need to go to the police station… they are the only people that can get that.. and if they dont have insurance your out of luck..

an insurance company has NO ACCESS to getting insurance info by just a license plate #… to do that u would need Drivers License #, DAte of Birth, full name, address, and in some cases even a Social Security #……

Can an auto insurance company legally collect for unpaid premiums?

July 16, 2010 - 10:14 pm 3 Comments

Here’s the situation: person sets up car insurance through an employee plan to automatically deduct from their paycheck. Goes on with life; insurance policy is in effect. Over a year later, gets a call from insurance company saying hey, whoops, we messed up and were actually billing someone else for your policy. You owe us a year and a half worth of premiums right now. Person didn’t realize because she assumed it was one of the many nonsensical acronyms being deducted from her paycheck. Is the insurance company legally entitled to recover this money from the person?

No, don’t pay them. Just switch companies. It’s their mistake, their problem. The only real issue is if you ever used the insurance on a claim or not? If you did, than you would be liable for the premium or the damages. If no claims were paid out, than it’s a wash. Insurance is for peace of mind sake and to satisify the BMV laws. You have to have coverage according to law which means if you get a random letter asking for proof of coverage, you must show you had coverage for the dates they are requesting. I just got one yesterday and they want proof from the Nov 09 period through now. That’s what you really have to worry about, so go out and get some coverage. I have Allstate, they have always done me right price and service (and yes I’ve had claims). But who would go back and pay a year and a half premiums for an insurance companys mistake. I would never do it. Insurance bebenfits are not tangible unless they paid something. So in reality, you have not had coverage for the past year and a half. Oh well, good thing nothing happened? Now get some coverage from another company and make sure your premiums are paid. As for your present company, I would offer to pay them for the current quarter. My billing period and new ID cards take affect every quarter. So that’s why I mention that. If they can’t accept that, too bad! They want to get nasty, talk to a lawyer. I am sure he would say dont pay it also! Good luck to you!

Am I allowed to switch my auto insurance company?

July 16, 2010 - 10:10 pm 9 Comments

Am I allowed to switch my auto insurance company if I am in the middle of my policy with another company? Any penalties?

only "penalties" may come from the insurance company themselves for dropping a policy early. the only thing you have to make sure of is that your new company puts the coverage into effect just before the old one is cancelled. if you dont and there is a delay in switching it over resulting in a period of not having coverage, the state will consider it a lapse of insurance and then they WILL fine you. trust me, i have had that happen

When an auto insurance company makes a payout do they go by Kelly Blue Book private party or retail value?

July 16, 2010 - 10:10 pm 4 Comments

I was involved in an auto accident which I was not at fault for and was curious, considering it looks like the damage out weighs the actual value of the vehicle, when the insurance company cuts the check do they base it off of "private party value" or "retail value"? Its a 98′ Honda Civic sedan EX, and im just wondering how much I should be expecting…

They don’t go by Kelly Blue Book.

If they use a book – it will be the NADA (National Automobile Dealers Assoc.) book.

If they pay based on the book – they will start with the retail value. Then subtract for mileage and condition. So…if your car needs new tires….there will be a deduction for that.

However, many companies use a market survey program (such as CCC or Total Logic). These are not products you have access to. But if the insurance company uses one….they can send you a copy of the report and let you see it.
