Police refuses to release documents needed for life insurance claim?

What legal action can I take if the police refuses to release a Post Mortem report and Police Statement (of what happened) that I need for a life insurance claim? The insurance company refuses to pay out unless they get these 2 documents! We’re talking millions of dollars here.

Many departments will not release information unless a FOIL
( Freedom of Information Law ) is submitted. Ask them what the procedure is.

Car accident took place one year back, if I go to collision center and ask them to evaluate, will they know that damage is old and will insurance company claim it as a crime? Whats best option?

Yes they will know. If you damaged the car and afterward bought insurance and filed a claim, it is called insurance fraud and could mean jail time

This was an accident where I accidentally scraped a mailbox, putting an indention into the side of my car…it is about a $1,500 repair; my old insurance had a $500 deductible, but I never filed-and now I am wanting to change companies. For lack of a better term, is this like having a pre-existing condition with medical insurance?

You cannot claim it as you were not covered with the new company at the time of the incident.

I was with Endsleigh Insurance up until February last year. When my policy ended they sent me a cheque for £120 claiming it was some kind of refund. Obviously I took the money and spent it. A year down the line, they’ve written me a letter saying they gave me the cheque by mistake and want their money back.

Can they do this? It all seems a bit fishy to me.

I filed an auto insurance claim and they sent me a check. But I want to sue the person who hit me myself. Am I able to return the check and have the insurance company send me a release letter saying they wont sue the person who hit me? Will they do that? Also am I allowed to get copies of my insurance paperwork from them?
I dont have an attorney. I am taking it to small claims myself.

You did not give enough information to answer. I assume that you have talked to an attorney about this suit. Ask him for the answer.

Assuming the healthy are financially savvy all healthy individuals will just become criminals & wait till they are sick to buy insurance. The insurance companies will go bankrupt & the insurance will become worthless.

Personal injury claims are calculated by adding up the obvious & the incidental:
1. Medical treatment & rehab costs
2. Loss of income during injury rehab
3. Physical & mental distress caused by the injury itself

Insurance companies calculate the final compensation payable to you based on the severity of your injury.

For a simple injury, the compensation is (1.5 x damages cost) + total loss of income resulting from the injury

If the injury is severe, the compensation is (5 x damages cost) + loss of income

Can mortgage company file an insurance claim on 3 year old foreclosed home that was included in bankruptcy?

I filed CH 7 Bankruptcy 3 years ago and the mortgage company foreclosed on the property. MY insurance company just called and said the mortgage company called them and filed a claim on the house for roof damage and if they paid it there is a $2000.00 deductible I will have to pay. Is this right? I have not lived in the home for 3 years!

I’m not an expert in Bankruptcy and foreclosure procedures but this doesn’t smell right. If the damage to the roof occurred during the time that your insurance was in force, why are they only now contacting you? To my knowledge, all HO insurance coverage is based on the date of the occurrence or loss. That means that whichever insurance company was insuring the home at the time the loss occurred, is responsible to handle and pay the claim. It is hard to believe that a loss over 3 years old would just now be discovered and filed.

Once a tree limb fell down during an ice storm and damaged my front sidewalk. They wouldn’t pay to have the sidewalk repaired. Another time I needed plumbing done and the plumbers had to knock out the kitchen ceiling and part of a wall to get to the pipes and the insurance also wouldn’t pay to have the plastering done. The insurance agent says that these things are considered part of normal maintenance and so aren’t covered. What do they ever pay for?

Homeowners policies do not pay for maintenance stuff. It pays for sudden, accidental, unanticipated damage to a covered structure.

Sidewalk and driveway isn’t covered structure. But normally, if you have a leak, on a standard HO3 policy, the damage a plumber has to do going through your walls to get to the pipe, IS covered. It would depend heavily, on WHY the plumber had to get to pipes.

They pay for damage to your structure, that is NOT excluded. If the tree fell on your roof and damaged it, it would have paid for that. It covers fires, obviously, unless you set them yourself on purpose (arson). Theft claims are also pretty common.

I’d double check with the agent . .. maybe they’re discouraging you from filing claims, unjustly. And maybe you should sit down and read your policy for yourself . . . to get an idea of what exactly isn’t covered.
