			<content:encoded><![CDATA[<p>If the insurance company denies a NJ PIP claim for service made more that two years ago, must I pay the claim? Or does the statue of limitations also cover me as well.<br />
<br />The statute only specifically mentions insurance companies and lawsuits for injuries generally have a 6 year limitation. It is unclear from the statutes if it s possible to sue someone whose insurance did not cover an accident, especially if the person did not properly request payment from the insurer. I would speak to a lawyer about it.</p>

<br />NJ is a PIP state so your insurance will not increase for injury claims in a not at fault accident.  So, that is not an issue.  If you request that your auto insurance is primary, there IS a deductible and copayment and the PIP medical expense coverage is limited to $250,000 (at least that is what it used to be, I don&#8217;t think it has changed recently).  The premium savings to make your health insurance primary used to be in the neighborhood of $20 per year, not worth it.  You would have to ask your agent for a quote.<br />
You can still always go to your health insurance if you use your PIP up &amp; need more coverage.<br />
The problem with health insurance being primary is that most health insurance policies have a lifetime maximum benefit (used to be $1,000,000 &amp; I some are $2,000,000).  The PIP coverage is per accident with no lifetime maximum, so technically, you can have several accidents over the years, use you maximum PIP benefit &amp; it will still be there for the next accident.  If you had used your health insurance, every accident decreases the lifetime maximum.  What if you had a serious accident &amp; then a serious disease?  You may run out of health insurance.<br />
I personally would leave your auto accident related medical with auto insurance as primary &amp; save your health insurance for other accidents (falling, stitches, etc) and disease.<br />
Also, medicare &amp; medicaid may not allow you to use them as primary in an auto accident, you would have to check with them if you were considering this.</p>

I do not live with my parents.<br />

<br />I have two answers: one for where you might find insurance and one about bariatric surgery. The short answer for where you can find health insurance is: it depends. You can find coverage through most health insurance companies, but most private insurers include riders on their standard policies that deny coverage for bariatric surgery. According to a New Jersey Work Group report on bariatric surgery, HMOs in the state must include coverage for bariatric surgery. I’ve included a link to the report, which also alludes to Medicare/Medicaid changing its stance on coverage for this procedure. It wasn’t until this year that Medicare/Medicaid considered obesity an illness and expanded coverage for obesity treatment. The next link in the sources section is to a New Jersey HMO report card rating HMOs in the state.</p>
<p>The above answerer quotes an interesting article from a medical group that specializes in obesity treatment. You’re kind of lucky that you are looking for treatment in New Jersey because the state conducted an in-depth study into how well bariatric surgeries are being executed. This was in response to the fact that the number of procedures increased by almost 10 times in just five years. I’ve linked to the press release describing the results of the Work Group study. Although they did not recommend any strict rules for where to go for treatment, they did say that a successful bariatric program “would perform at least 125 surgeries a year, with each surgeon having a lifetime experience of at leat 125 procedures.” The report also goes on to say that a good program would include a physician medical director for bariatric surgery.</p>
<p>You might want to use the above criteria to find doctors that you’d want to perform the procedure. I’ve included a link to a list of New Jersey doctors who specialize in bariatric surgery. Then you can see what health insurance the work with and go from there. I would also speak to health insurance agents in your area.
