What does "We (insurance company) have denied liability to the other driver?"?

Letter stated the denial and also that the laws of this state are such that a person whose negligence is 50% or more or more is barred from recovery of damages. Therefore my insurance company has denied liability to the other driver.

Having never had an accident before after decades of driving I’m not sure what they mean. Whom have they placed at fault? They’re closed today, so can’t talk to their rep.

It means that they think the other driver was >50% at fault for the accident, and that they are not going to pay him/her anything.

Do you run a home day care in Ontario? Advice needed re: liability insurance?

My wife is planning to start a home day care business, and would liek to obtain liability insurance. When I called in my current insurance company they said they can’t insure out home anymore as this would be deemed as "high risk". We have to either get separate liability insurance and present proof to them, or go with acompany that can cover both our home & liability insurance.
If you have a home day care, could you please advise on where to start looking for this type of insurance? I have contacted a few big name companies, and they don’t offer it.

I don’t know who does this in Canada, but I can tell you you’ll have better luck with a smaller, regional insurance company than a large one.

But the real thing to do here, is see if there’s a professional organization near you – daycare resources, etc, where you can talk to other daycare providers, and find out who does THEIR homeowners insurance.

There ARE some carriers that, for a small fee, will let you do a daycare in your home, on a homeowners policy.

Do auto insurance companies take advantage of prices since the liability laws went into effect?

Your question seems to imply that since everyone is now required to have insurance to drive, that insurance companies are raising prices and gouging customers. Is that what you’re asking?

If so, the answer is no, and the opposite has happened. With a larger base of customers the prices on individual policies have dropped.

Generally, cost of claims divided by number of customers is what sets the base rate for insurance. A surcharge is added for every risk factor the customer poses of course, under 25 is a risk, sport car driver is a risk, even location is a risk in some cases.

But no, since the base rate dropped, so did premiums to the customer.

where can i find general liability insurance for home inspectors?

i am currently getting my license to be a home inspector in Arkansas and the state requires that home inspectors carry a general liability policy of $100,000. My own insurance company does not do these kind of policies.

You need to find a local, independent agent who can shop this out for you. You’re not likely to find a carrier willing to write a $100,000 limit. Or rather, they will, but they’ll charge the same premium as a $1,000,000 limit. NOBODY carries $100K any more. No business will let you work for them with a limit that low.

Expect it to cost you around $1200.

You didn’t ask, but, btw, an agent who’s not willing and/or able to meet SOME of your insurance needs, probably isn’t the right agent for ANY of your insurance needs.

Who sells affordable professional liability / malpractice insurance for dentists?

Looking for more affordable insurance for me, my partners and our dental practice. We think there is too little choice of insurance companies offering professional liability and other commercial insurance to dental practices and dentists. Does anyone know who else can offer us more choices in competitive coverage?

Well, professional liability isn’t much of a moneymaker, from the insurance company’s point of view. Luckily for you, dental malpractice is a lot less hazardous, however, unluckily for you, most insurance companies won’t offer just ONE class of malpractice insurance.

That means, in any given state, there is very, very little competition for professional liability coverage. You don’t say where you are, but there are probably less than five carriers in your state. Several of those would probably be non-admitted carriers.

The best thing to do is see if you can hook into a state wide professional group, and have the group negotiate a 5% cut in rate based on volume discount.

A typical homeowners policy covers the liability arising from the use of a handgun. Obviously the policy would not cover an intentional act or its use in a criminal act but legal liability for damages arising from an accident involving a firearm is covered.

If you have a homeowners policy ask your agent to show you where your liability for an accidental injury to a third party arising from the lawful use of a firearm is excluded.

Professional Wrestling Liability Insurance?

I am having a hard time finding a liability insurance company to underwrite for professional wrestling. Not to just cover spectators; but to cover wrestlers too. Does anyone know of a Insurance company that will underwrite this?

Seriously, there’s no "liability" involved with wrestling injuries. That’s because liability involves UNFORSEEN, accidental injuries. When you have two people physically trying to, well, hurt each other, there’s not much of an element of RISK involved.

Professional athletes – including wrestlers – usually are "self insured" for any injuries they incur. It’s not an insurable risk, because you can’t collect enough premium to cover the medical bills that WILL be incurred.

So. That product isn’t out there, to the best of my knowledge, which is why you can’t find it. Oh, and if it WAS out there, it would be called "group accident", "workers compensation", or "health" coverage.

I had Allstate at one time because it appeared to have the best deal on such coverage while my car insurance has been through Mercury. I’m interested in basic liability, no comp & collision. I’ve got a clean driving record, car license for years but only a motorcycle permit currently.

How does liability insurance apply to a house?

A few weeks ago a city contractor was hired to tear down the condemned building next to our house. Somehow, he managed to nick our house with his trackhoe and took out a chunk of our roof. At the time, he promised to fix it but now his insurance company is using words like "liability insurance" and "depreciation" and it almost sounds to me like this is going to cost US a bunch of money. We considered going through our own insurance but then our rates would go up.

This was 100% his mistake. How do we make sure that he is the one to pay for it?

You can’t make sure he actually pays for anything.

You can sue him, but state law would say how much he has to pay.

The safest thing, is to file the claim with your insurance company, and let them chase him down, assuming there’s a lot of damage. If the damage is under $1,000, then you just have to trust that his insurance will do right by you.

But if your roof was old, and needed to be replaced ANYWAY, they don’t pay as much as they would, if your roof was brand new. THEY don’t have to pay replacement value – legally, they only have to pay actual cash value (replacement less depreciation). They pay what it’s WORTH. Only YOUR policy has to pay for replacement value, IF you have that kind of coverage.
