What is the liability of the insurance company of the driver who was allocated 100% liability in an accident?

I got hit in an accident and I was allocated no liability. My car is in the body shop right now. However, the insurance company of the guy who hit me sent an estimate to the body shop and requested a NON-FACTORY bumper for my car. My car was 100% factory-made before the accident. The insurance company argued that they only owe me whatever to put my car back to the same functionality before the accident, but not the same quality.

That absolutely sounds unacceptable to me. Per my understanding, they should have no right choosing the components of my car. I should be the one who choose it. The thing is that I am not requesting anything extra than what my car was before the accident. Is there anyone know what the California State Law says about this. Thank you very much!!!

Why don’t insurance companies insure the driver throug his operators license, rather than the car itself?

Insurance companies insure the car, when it comes to liability insurance. Why not insure the drivers license instead? That way, the driver is truely insured, no matter how many cars are owned. Or if borrowing a car, the driver is still insured. When renting a car, the driver is insured still. All liability insurance then would be based on a person’s driving record, and not the car itself. The car can be insured for other purposes, such as theft, fire, or other reasons. But, if the driver is insured on his or her license, then the person would be covered on all cars driven. And it is fair that way, because it would be based on driving record.

Wow what an idea! It would save us money as the consumer but the insurance companies are out for big bucks and dont care about saving us the money. I don’t understand how they rate a car and how one car is more expensive to drive when its how the driver of the car operates the car and not the make and model! Your idea makes so much sense to me :-) Get a hold of the congressmen in your areas and see if we can get it changed!

Where should I get liability insurance for my DJ business?

I am going to be setting up at "booth" at a local flea market to promote my DJ business. The flea market requires that I carry liability insurance. Can someone please recommend to me an insurance company that provides low cost liability insurance?

Well, the minimum premium for this sort of thing is going to be about $600. You won’t find it for less than this.

The reasoning – to cover the expenses of issuing the policy in the first place.

Just like, say, you charge $400 to DJ a party for 4 hours. That’s $100 an hour. If someone says, ok, I only want you for 15 minutes, do you charge $25 for that? No, because it’s not worth your time & travel expenses – you have a minimum charge to just show up.

So as to where – any local, independent agent should be able to get you a quote for this. You’re NOT going to find it with the State Farm, Allstate, Farmers agents, it’s just not the type of thing they do. So if your personal car insurance is with an independent agent, go see them first.

How can I get car liability insurance without USA drivers’ license?

I am a foreign citizen and we would like to buy a car in San Francisco for a cross country trip. The only problem seems to be the car liability coverage insurance, which is obligatory to have when driving. How the others do, who make such trip? Are there insurance companies offering daily rates, or periodical packages with not American drivers’ license? Car rental places offer liability insurance for 12.99 per day, so I think of something, like that.

Where is the car going to be registered? You can’t buy a car in the US, and register and insure it to a foreign address. Are you actually resident in San Francisco? There are exceptions for military personnel stationed in the US, but it is a little different for a tourist.

well, health!! Because you’re MOST likely to have claims!!! Liability is second, because if you do get a claim, it’s likely to be large, and life is the lowest risk, because most people don’t keep the policy active long enough for them to die – ie, they pay for a few years, then let it cancel.

If you hit an uninsured motorist and have liability insurance does your insurance company have to pay the uninsured motorist? Also, If you don’t have insurance and get in a non-fault car accident, do you have to pay the other vehicle because you don’t have insurance?

As far as I know if you only have liability and are at fault it doesn’t matter if they have insurance your company pays and your SOL. If you have liability and the uninsured motorist hits you your still SOL. You can sue them but chances are if they don’t have insurance they also don’t have any money.

If any accident is non-fault I don’t think either of you have to pay for the other person but you can try to make them in civil court and vise-versa.

I am looking into it right now and would like to know what it is going to cost me before checking out insurance companies. if you just a have general round number that’s fine, or if you can provide specific examples that’s even better. Thanks in advance. The compnay I am looking to form is a uniformed security guard unarmed company if that helps.

There are too many variables here to give you one easy answer. It may depend on your loss experience, whether you do background checks of your employees, etc etc. Security services tend to be expensive to insure, because most people don’t provide very good training or do background checks. Call an independent agent, and they will shop around for you to get you the best deal. Also , a $1M GL policy is probably not enough.

When I hit another car and if I have liability insurance the insurance company is going to pay for the other guy’s car repair if it is my fault. If it is the other guy’s fault his car insurance company is going to pay me for repair. Then why do people take comprehensive car insurance?

If I hit a wall or tree then it may help, but it happens very rarely.

Is it legal for insurance companies to admit liability and then change their mind?

Last week I was involved ina car accident. I was travelling straight across a cross roads whilst the other drive was supposed to be waiting to turn right and ended up cutting straight in front of me and hitting me front on. There is a quite a bit of damage to my car (£1300) and a small amount to his. At the scene of the accident, he admitted liability and seemed very genuine and concerned. We took each others details and then he left as his car was drive-able, the police arrived about 5 minutes after he left and took my details and my explanation of the accident. He then failed to answer the phone to me and the insurance company for around a week until I managed to get his home number and speak to his dad. He then rang up the insurance company, admitted liability and his insurance company rang me and told me they were excepting liability. They arranged to pick up my vehicle, get it fixed and provide me with a hire car. An hour and a half later they rang me back to tell me they had changed their mind. Are they allowed to do this? We’re both with the same company, and they don’t seem to be fighting my side at all. I have CCTV footage which shows him in the wrong, but they don’t seem interested in seeing it even thought I insist.

Tricky one – you could ask for the insurance company to send you a recording of the conversation. You could advise them that you will be using their admission in a court of law should it come to that.

They will then probably re-admit lianility.
