Lawn Care Business Insurance Basics. Gopher Lawn Care Business Forum Podcast Show

I have been able to have a few discussions on landscape contractor insurance over the years to help you understand the topic better. In this most recent discussion I had an opportunity to talk with an insurance agent who sold insurance mainly to the lawn care industry. Here are some of the insights he shared on the Gopher Lawn Care Business Forum that I hope you find beneficial.

What kind of insurance does a lawn care contractor need?

What insurance coverage a contractor needs is dependent on the type of work he or she engages in as well as the risks associated and protection desired. The general purpose of contractor insurance is to provide financial backing for a contractor who is liable to a client who hires the contractor to perform a certain job. The most purchased type of contractors insurance is general liability insurance. As with other types of insurance, contractor general liability offers the widest protection and is most useful to a company or individual engaged any many facets of contract work. There are maximum payouts on the insurance, generally $1 million to $2 million for each type of protection. Contractors protected by a good plan are usually secured against reasonable financial loss due to problems linked to the contractors work. The most complete protection can be found from adding some more specific types of coverage to the general liability protection.

Lets talk about those some of those more specific types of insurance. How about workers compensation. Can you tell us a little about that?

Workers compensation is a common contractor insurance purchased by many contracting companies for their employees. Workers comp insurance is a compulsory type of coverage. This protection helps the employer cover the financial burden of an employee who is injured on a job. The workers compensation insurance generally offers income, medical and rehabilitation benefits for injured employees involved in work related accidents. Some plans also include a death benefit payable to survivors. Business owners/principles may choose to exclude their payroll (and coverage) in some states, with coverage rated only on employee payroll.

How about inland marine insurance? This isnt one we hear about often but it is helpful to know about.

Inland marine insurance is another specialized type of contractor insurance. This contractors insurance protects goods that are in transit over land. Many contractors move materials and goods routinely and this allows them to expect the high costs of those items. Tools, equipment and installation floaters are all considered inland marine insurance and are considered essential types of insurance for contractor.

What about disability insurance?

Disability insurance is another common type of contractors insurance used by contractors and many companies, for that matter. This provides for the income needs of people displaced from work for a period of time due to injury. It is commonly referred to Accident and Health Protection. Health and life insurance are other types of coverage purchased by contractors.

Another common type of protection for contractor is surety bonds. A surety bond is a financial instrument not an insurance policy. A Surety Bond is a financial instrument utilized to guarantee performance. Say for instance a building developer hires a general contractor and the contractor is unable to perform on his obligation to complete a building on time or as agreed. The developer may look to sue contractor for not performing as promised. A performance bond provides protection for this type of exposures. License and permit bonds are required by the cities, municipalities or state. It guarantees compliance with the local, state, or federal codes. Another reason for requiring a license bond is to provide protection to the consumers. Along with contractor workers comp insurance, many states require contractors to have contractor license bonds.

Art Williams – Do It – part 2 of 2

I was in Primerica (formerly the A.L.Williams company) selling term life insurance and mutual funds for 18 months and I got my guts cut out. I made $500 full-time in that year and a half. But I never quit. And somewhere along the way I had a revelation: my number one job in Primerica is to become just like my coach, Art Williams. If I became just like him, and did what he did, I would have what he had. I knew as a coach what he wanted most was for his people to do exactly what he says, so I wrote him a letter, telling him what I was going through, but what he was teaching me and how I understood the difference between winning and losing, and what my plans were for the future. Now Art, who is a billionaire, never met me, has a great family, great relationships, hundreds of close teammates around the world, and had just had heart surgery and was living on borrowed time, cared enough about a loser like me a thousand miles away in another country to write me a letter. Keith Olbermann investigates United Health Group on Countdown and “In a victory that same month, the American Medical Association and others reached a $350 million settlement with UnitedHealth Group, the nations second largest insurer, over what the AMA charged were unfairly low out-of-network payments. That dovetailed with another agreement New York Attorney General Andrew Cuomo reached with UnitedHealth to help fund a new independent means of determining appropriate payment rates for out-of-network care.” (http://www.msnbc.msn.com/id/32484021/ns/health-health_care/) CEO: Stephen Hemsley – UnitedHealth Group Total Compensation: $3241042 — Following on the heels of an $895 million class-action suit settlement over stock-option back-dating, UnitedHealth Group has now agreed to settle charges that it violated a myriad of securities laws, though it managed to obtain the settlement without admitting or denying the allegations, or without paying a monetary penalty. UHG didn’t pay anything out because it showed “extraordinary cooperation” in the investigation, the agency said. (For that kind of get-out-of-fines-free card, UHG execs must have done the limbo and offered up their first born.)

Ron Paul: More Government Won’t Help (Floor speech on healthcare 9/23/09)

Government has been mismanaging medical care for more than 45 years; for every problem it has created it has responded by exponentially expanding the role of government.
Points to consider:
1.) No one has a right to medical care. If one assumes such a right, it endorses the notion that some individuals have a right to someone elses life and property. This totally contradicts the principles of liberty.
2.) If medical care is provided by government, this can only be achieved by an authoritarian government unconcerned about the rights of the individual.
3.) Economic fallacies accepted for more than 100 years in the United States has deceived policy makers into believing that quality medical care can only be achieved by government force, taxation, regulations, and bowing to a system of special interests that creates a system of corporatism.
4.) More dollars into any monopoly run by government never increases quality but it always results in higher costs and prices.
5.) Government does have an important role to play in facilitating the delivery of all goods and services in an ethical and efficient manner.
6.) First, government should do no harm. It should get out of the way and repeal all the laws that have contributed to the mess we have.
7.) The costs are obviously too high but in solving this problem one cannot ignore the debasement of the currency as a major factor.
8.) Bureaucrats and other third parties must never be allowed to interfere in the doctor/patient relationship.
9.) The tax code, including the ERISA laws, must be changed to give everyone equal treatment by allowing a 100% tax credit for all medical expenses.
Laws dealing with bad outcomes and prohibiting doctors from entering into voluntary agreements with their patients must be repealed. Tort laws play a significant role in pushing costs higher, prompting unnecessary treatment and excessive testing. Patients deserve the compensation; the attorneys do not.
10.) Insurance sales should be legalized nationally across state lines to increase competition among the insurance companies.
11.) Long-term insurance policies should be available to young people similar to term-life insurances that offer fixed prices for long periods of time.
12.) The principle of insurance should be remembered. Its purpose in a free market is to measure risk, not to be used synonymously with social welfare programs. Any program that provides for first-dollar payment is no longer insurance. This would be similar to giving coverage for gasoline and repair bills to those who buy car insurance or providing food insurance for people to go to the grocery store. Obviously, that could not work.
13.) The cozy relationship between organized medicine and government must be reversed.
Early on medical insurance was promoted by the medical community in order to boost re-imbursements to doctors and hospitals. That partnership has morphed into the government/insurance industry still being promoted by the current administration.
14.) Threatening individuals with huge fines by forcing them to buy insurance is a boon to the insurance companies.
15.) There must be more competition for individuals entering into the medical field. Licensing strictly limits the number of individuals who can provide patient care. A lot of problems were created in 20th century as a consequence the Flexner Report (1910), which was financed by the Carnegie Foundation and strongly supported by the AMA. Many medical schools were closed and the number of doctors was drastically reduced. The motivation was to close down medical schools that catered to women, minorities and especially homeopathy. We continue to suffer from these changes which were designed to protect physicians income and promote allopathic medicine over the more natural cures and prevention of homeopathic medicine.
16.) We must remove any obstacles for people seeking holistic and nutritional alternatives to current medical care. We must remove the threat of further regulations pushed by the drug companies now working worldwide to limit these alternatives.
True competition in the delivery of medical care is what is needed, not more government meddling.
